By engaging MD Photonique Inc. for consulting services or using our software tools ("the Services"), you agree to be bound by these Terms of Service.
MD Photonique Inc. provides photonics consulting services including optical system design, custom simulation software development, laboratory instrumentation, and technical advisory services.
Access to certain software tools and services may require registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration and to update this information as needed.
Our IP: MD Photonique Inc. retains all rights, title, and interest in our proprietary software, simulation tools, algorithms, and methodologies. Your Data & Results: You retain full ownership of the data you provide and the results generated through our services. We grant you a license to use deliverables as specified in your service agreement.
You agree to use our services and software tools only for lawful purposes and in accordance with these Terms. You shall not use our services to violate any applicable laws or regulations, attempt to gain unauthorized access to our systems, reverse engineer or decompile our software, or redistribute our tools without authorization.
Simulation tools are approximations of physical systems. While we strive for accuracy, MD Photonique Inc. does not guarantee that simulation results will perfectly match experimental outcomes. Clients are responsible for validating results before applying them to physical systems. We are not liable for equipment damage resulting from reliance on simulations without proper experimental validation.
Services and software tools are provided on an "AS IS" basis. MD Photonique Inc. disclaims all warranties, including fitness for a particular purpose and non-infringement.
MD Photonique Inc. shall not be liable for indirect, incidental, or consequential damages arising from use of our services. Our total liability shall not exceed the fees paid for the specific service giving rise to the claim.
These Terms are governed by the laws of the Province of Quebec and the laws of Canada applicable therein. Any disputes shall be resolved in the courts of Quebec.
